These Terms of Use govern your access to and use of dwellordrive.com and the DwellOrDrive calculator. In these Terms, “DwellOrDrive,” “we,” “us,” and “our” refer to the independent operator of the website, which is based in East Palo Alto, California, United States.

1. Acceptance of these terms

By accessing or using DwellOrDrive, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the site.

2. Eligibility

You must be at least 13 years old to use DwellOrDrive. If you are under the age of legal majority where you live, use the site only with the involvement of a parent or legal guardian.

3. What DwellOrDrive provides

DwellOrDrive is a free educational tool that compares user-supplied housing costs, direct commuting expenses, and a user-selected value of travel time. It may also provide general explanatory content about the assumptions and formulas used.

4. Estimates only; no professional advice

DwellOrDrive results are estimates based entirely on assumptions and values entered by the user. The site does not provide financial, legal, tax, accounting, investment, employment, transportation, insurance, real-estate, housing, or other professional advice.

DwellOrDrive does not recommend a particular home, job, commute, vehicle, transit option, or financial decision. Consult qualified professionals and authoritative sources when advice or verification is needed.

5. Your responsibility

You are responsible for choosing inputs, checking the accuracy and relevance of those inputs, understanding the methodology, and independently verifying information before acting. Actual costs and outcomes may differ because of traffic, schedules, taxes, fares, fuel prices, maintenance, depreciation, tolls, parking, housing expenses, benefits, emergencies, personal circumstances, and other factors.

Do not use DwellOrDrive as the sole basis for a move, lease, purchase, job acceptance, resignation, commuting decision, or other significant commitment.

6. No guarantee of outcomes

DwellOrDrive does not guarantee savings, accuracy, completeness, availability, suitability, search visibility, employment outcomes, housing availability, or any particular financial result.

7. Permitted use

You may use DwellOrDrive for lawful personal, educational, and internal business evaluation purposes. You may share a link to the site or a result generated for your own use, provided you do not misrepresent the result or imply endorsement by DwellOrDrive.

8. Prohibited use

You may not:

• use the site for unlawful, fraudulent, deceptive, or harmful activity;
• interfere with, probe, overload, or disrupt the site or its infrastructure;
• bypass access controls, security measures, or usage restrictions;
• introduce malware, automated abuse, or malicious code;
• copy, scrape, republish, sell, or commercially exploit substantial portions of the site except as permitted by law or written permission;
• misrepresent DwellOrDrive results as certified, guaranteed, or professional advice; or
• use DwellOrDrive branding in a way that suggests affiliation or endorsement.

9. Intellectual property

The DwellOrDrive name, branding, site design, original text, calculator presentation, and other original materials are owned by the operator or used with permission and are protected by applicable law. These Terms do not transfer ownership rights to you.

10. Third-party links, advertising, and referrals

The site may later display advertisements, affiliate links, or links to third-party services. Any material commercial relationship will be disclosed where required. A commercial relationship will not change the calculator's formulas or determine its results. Third-party services are controlled by their own operators, terms, prices, and privacy practices. DwellOrDrive does not endorse or guarantee them merely by linking to or displaying them.

11. Availability and changes

DwellOrDrive may modify, suspend, restrict, or discontinue any part of the site at any time. Features, formulas, content, routes, and availability may change without prior notice. The site may occasionally be unavailable because of maintenance, service-provider interruptions, security events, or circumstances outside the operator's control.

12. Disclaimer of warranties

To the fullest extent permitted by law, DwellOrDrive is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, title, noninfringement, and uninterrupted or error-free operation.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, DwellOrDrive and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, lost data, lost opportunities, moving costs, housing costs, employment losses, or decisions made in reliance on the site.

To the fullest extent permitted by law, the aggregate liability of DwellOrDrive and its operator arising out of or relating to the site will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid directly to DwellOrDrive for use of the site during the twelve months before the event giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be excluded or limited, including liability arising from fraud, willful misconduct, or other conduct for which exclusion is prohibited by law.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless DwellOrDrive and its operator from claims, damages, liabilities, losses, and reasonable costs arising from your unlawful misuse of the site, your material violation of these Terms, or your infringement of another person's rights.

The Privacy Policy explains how information is handled and is incorporated into these Terms by reference.

16. Accessibility

DwellOrDrive aims to provide an accessible experience. The Accessibility page describes the current approach and how to report an access barrier.

17. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Except where applicable law requires otherwise, disputes arising from these Terms or the site will be brought in the state or federal courts located in San Mateo County, California, and you consent to their jurisdiction and venue.

18. Severability and waiver

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

19. Changes to these terms

These Terms may be updated as the site or legal requirements change. The revised Terms will be posted on this page with a new effective date. Your continued use of the site after revised Terms take effect means you accept the revised Terms to the extent permitted by applicable law.
